Sonosfera ("we", "us", "our") provides licensed background music streaming for commercial venues including salons, cafes, retail stores, hotels, and offices. These Terms of Service ("Terms") govern your access to and use of the Sonosfera platform, website, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Music Rights & AI Transparency
How Our Music Is Created
Music available on Sonosfera is created using AI-assisted composition tools under meaningful human creative direction. Our team provides the creative vision, mood direction, genre selection, and curatorial oversight that shapes every track in our catalogue. In accordance with the EU AI Act (Article 50, effective 2 August 2026) and emerging transparency standards, we disclose that our music production process involves AI tools as part of the creative workflow.
Your Commercial License
We hold full commercial rights to all music on the Sonosfera platform. Your active subscription grants you a non-exclusive, non-transferable, revocable licence to stream our music at your registered business location(s). This means:
- No third-party record label involvement or disputes
- No risk of music being removed due to label conflicts
- No additional PPL, PRS, ASCAP, BMI, or SESAC fees are required for Sonosfera music
- Stable, predictable pricing with no surprise royalty costs
What You Are Licensed to Do
With an active subscription, you may:
- Stream and play music at your licensed business location(s) as background music
- Record social media content at your venue with our music playing
- Livestream from your venue with Sonosfera music in the background
- Use our music at events held at your licensed venue
- Feature our music in advertisements and promotions for your business
What You May NOT Do
- Download, copy, or extract music files from the Service
- Redistribute, resell, sublicense, or commercially exploit the music outside your licensed venue(s)
- Use music at locations not covered by your subscription plan
- Share your login credentials with others or allow third-party access
- Use music after your subscription ends or is terminated
- Use the music in any unlawful, defamatory, or misleading manner
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
AI Content Disclosure
In compliance with the EU AI Act and international transparency standards, we confirm that tracks in our catalogue are produced with the assistance of generative AI technology. Human creative direction, curation, and quality control are integral to our production process. Metadata for each track identifies it as AI-assisted content where required by applicable law.
3. Account & Device Rules
One Account, One Location
- Starter Plan: 1 location
- Professional Plan: Up to 3 locations
- Enterprise Plan: Unlimited locations
Each subscription plan specifies the number of business locations covered. Using the Service at locations beyond your plan allowance constitutes a breach of these Terms.
Device Management
Each location permits 1 active streaming device at a time. You may switch devices, but when you log in on a new device, your previous device will be automatically logged out. Attempts to circumvent this restriction may result in account suspension.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@sonosfera.app if you suspect unauthorised access.
4. Subscription, Payment & Billing
Billing
- Subscriptions are billed monthly or annually via Stripe, our third-party payment processor
- By subscribing, you authorise Stripe to charge your chosen payment method on a recurring basis
- All prices are displayed inclusive of VAT where applicable
- Stripe's terms of service apply to payment processing: stripe.com/legal
Auto-Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will notify you of any price changes at least 30 days before they take effect.
Failed Payments
If a payment fails, we will attempt to charge your payment method up to 3 times over 7 days. If all attempts fail, your access will be suspended until payment is resolved. We may also notify you by email.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your access continues until the end of the current paid billing period. No further charges will be made after cancellation.
Refunds
Refunds are governed by our Refund Policy. We honour the 14-day statutory cooling-off period under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive.
5. Data Protection & Privacy
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the EU General Data Protection Regulation (EU GDPR) where applicable. Full details are set out in our Privacy Policy.
As a B2B service, if we process personal data on your behalf (e.g., employee data linked to your account), we act as a data processor and you remain the data controller. We will enter into a Data Processing Agreement (DPA) upon request, in compliance with GDPR Article 28.
6. Intellectual Property
All content on the Sonosfera platform, including but not limited to the music catalogue, software, website design, logos, and trademarks, is the property of Sonosfera or its licensors. Your subscription grants you a limited licence to stream music as described in Section 2. No ownership of intellectual property is transferred to you.
The Sonosfera name, logo, and brand marks are trademarks of Sonosfera. You may not use our trademarks without prior written consent, except to factually reference your use of our Service.
7. Service Availability & Limitations
We strive for 99.9% uptime but do not guarantee uninterrupted service. The Service is provided "as is" and "as available". Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
If service is interrupted, check your internet connection first, then contact us. We will respond to all service disruption reports promptly.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- Sonosfera shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- Our total liability for any claim arising from these Terms shall not exceed the total fees paid by you in the 12 months preceding the claim
- We are not liable for any losses resulting from circumstances beyond our reasonable control (force majeure), including internet outages, natural disasters, or third-party service failures
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
9. Indemnification
Our commitment to you: We warrant that we hold the necessary rights and licences to provide the music on our platform for commercial background streaming. If a third party brings a copyright claim against you arising solely from your authorised use of Sonosfera music in accordance with these Terms, we will defend and indemnify you against such claim.
Your commitment to us: You agree to indemnify and hold Sonosfera harmless from any claims, damages, or expenses arising from your misuse of the Service, breach of these Terms, or use of the music outside the scope of your licence.
10. Termination
You may cancel your subscription and close your account at any time. We may suspend or terminate your account if you:
- Violate these Terms of Service
- Use the Service fraudulently or for unlawful purposes
- Circumvent device or location restrictions
- Fail to pay subscription fees after reasonable notice
Upon termination, your licence to stream music ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or an in-app notification. Your continued use of the Service after changes take effect constitutes acceptance. If you disagree with any changes, you may cancel your subscription before the changes take effect.
12. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For EU customers, nothing in these Terms affects your statutory rights under applicable consumer protection laws. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
